Terms and Conditions – Catchy Peak Digital Marketing Agency

General Terms

• We start the work only after the client accepts the Terms and Conditions.
• A WhatsApp group will be created, and all discussions within the group will be considered valid. Any personal conversations with team members outside the group will not be considered valid.
• Call support is available between 10:00 AM – 5:00 PM on working days.
• The bill / renewal bill will be generated automatically on the updated dates. Delays in providing content will not be considered a valid reason to change the billing date.
• The client is committed to paying 100% of the payment for monthly packages.
• For website and digital marketing packages exceeding three months, 50% payment is required upfront upon initiating the work, and the remaining balance must be settled within 30 days from the invoice date.
• The minimum service period for digital marketing services is three (3) months, and the client must inform us one month in advance to end or cancel the service.
• The minimum service period for Website AMC is twelve (12) months, and the client must inform us two months in advance to end or cancel the service.
• Any additional charges will be determined based on mutual agreement between the client and the company for new work.
• We shall not be held responsible for any issues arising beyond the scope of our commitments (online platforms).
• Team Collaboration: Both the client and the agency must work together to ensure business growth and success.

Strict No Refund Policy

• Once the payment is completed, it is strictly non-refundable under any circumstances.
• In the event of termination, any payments made prior to the termination date shall remain non-refundable.
• The Company shall be entitled to compensation for all work completed up to the termination date.
• The client is responsible for clearing any outstanding payments due up to the termination date.
• No refunds will be provided for completed services, ongoing services, unused services, or partial services.

Additional Work Beyond Scope

• If the client requests additional work beyond the scope mentioned in the initial quotation shared during the meeting, such work will be charged separately.
• The Company reserves the right to discontinue the work after settling accounts with the client.
• No refund will be provided for any payments already made, regardless of service stage or usage.

Use of Work as Social Proof

• We may use the results of our services on our website and social media platforms as social proof, including case studies, without disclosing confidential client information.

Website

• Project Timeline: The Party agrees to engage in the accepted proposal’s services for a minimum period of two (2) months (if Website Development) to allow sufficient time for implementation and assessment.
• Duration: The initial term of this agreement will be as specified in the proposal, with an option for renewal.
• Websites are optimized, and safety measures are implemented to prevent known viruses. However, the Company is not responsible for technical issues such as hacks or external security breaches.
• Intellectual Property Rights: Upon full payment, all intellectual property rights related to the website will be transferred to the client.
• Database or Server Transfer: After completion of the three-year mandatory maintenance period, the Company will assist in transferring databases or servers if applicable.
• Minimum Three Years Annual Website Maintenance: It is compulsory to opt for a minimum of three (3) years AMC, starting with three months of free AMC.
• Server and Admin Access (client-side server): The client must provide server and website admin access within two hours of request.
• Website Yearly Renewal Payments: Annual renewal is mandatory. AMC charges will be 25% to 35% of the total website development cost, subject to market conditions.
• Revisions: Two (2) rounds of complete revisions are included. Additional revisions will be charged separately.

SEO

• SEO Support: For local and website SEO, the client must provide all requested information, content, and server access as required by our SEO team. Delays will affect performance.
• Expected ranking results may take 8 to 12 months, depending on business type, competition, and market conditions.
• SEO timeframes differ for each business, and results are not guaranteed.
• The SEO package starts from the take-over date, not from the inquiry or payment date.
• This SEO package does not include Google Ads.
• Algorithm Updates: Google’s algorithms change frequently, and the client must cooperate with SEO-related requirements to align with updates.

SMM / DIGITAL MARKETING

• Digital Marketing results depend on multiple factors, including algorithm changes, and may take 3 to 12 months to reflect significant impact. Results vary by business type.
• Content Design: Our team ensures professional and consistent content design.
• Content Calendar: A monthly content calendar will be provided. Client cooperation is mandatory for timely execution.
• Timely Responses: Delays in approvals or feedback from the client may affect content schedules.
• Real-Time Content: Clients must provide real-time photos, videos, posters, reviews, and materials as requested.
• Client Responsibility: If required assets or access are not provided, the agency is not responsible for performance impact.
• Advertisement Results: Ad performance depends on budget, platform, and niche. Results may vary.
• Meta ads typically require 3 to 7 days for proper analysis. During this learning period, it is recommended to avoid making any major changes to the ads.
• Advertisement costs are not included in the package. The client must add funds directly to their ad account.
• Project initiation may take 10 to 25 working days, during which optimization, planning, and setup activities will be carried out.
• Planned deliverables (content, Reels, ads) will be executed as scheduled for the month.
• If leads are unsatisfactory, strategies may be revised with additional deliverables subject to extra charges.
• Lead calls and WhatsApp messages will be directed to the client’s mobile number. The client is solely responsible for lead conversion.
